—In a medical malpractice action to recover damages for personal injuries, etc., the plaintiffs appeal from a judgment of the Supreme Court, Suffolk County (Cohalan, J.), entered August 31, 1990, which, after the close of the evidence, dismissed the complaint for failure to make out a prima facie case.

Ordered that the judgment is modified, on the law, by deleting the provision thereof granting the defendant judgment as a matter of law on the first and third causes of *473action, and those causes of action are reinstated; as so modified, the judgment is affirmed, and the matter is remitted to the…
