Appellant was convicted in the District Court of Rains County of murder, and his punishment fixed at ten years in the penitentiary.

Appellant shot and killed deceased with an automatic pistol in front of a gate to appellant's yard. He was a tenant on the farm of deceased who had lived in the same house with appellant till about two months before the shooting, at which time he moved away taking most of his household goods but leaving some.
