1. BACKGROUND

On March 27, 2003, shortly after midnight, a small, twin-engine airplane crashed in South Georgia. Both the pilot and co-pilot were killed. Plaintiffs United States Aviation Underwriters, Inc. (“USAU”) and Haulers Insurance Company, Inc. (“Haulers”) have brought the present lawsuit, pursuant to the Federal Tort Claims Act (“FTCA”) to recover the damages, losses, and expenses they incurred as a result of the crash. 1 Specifically, USAU and Haulers contend that sudden clear air turbulence (“CAT”) caused the accident.
