This is a petition for a rehearing of the case decided ante, page 312. Argument was heard at the request of one of the members of the court in accordance with the rule.

*347The first ground is that the court overlooked matters decisive of the case in deciding that there was not sufficient evidence to go to the jury on the question of estoppel in pais.
