OPINION
By ROSS, PJ.:
This is an-appeal on questions of law from a decree of the Court of ’Common Pleas of Butler County, rendered in a chancery case in favor of the plaintiffs, upon motion for judgment upon the pleadings.
These consist of a petition filed by Louis Richard Duemer and Walter Corlliss Duemer, children of Walter A. Duemer, deceased, who was a brother of Louis J. Duemer, an answer and cross-petition of said Louis J. Duemer and his wife, verified only by Louis J.
