MEMORANDUM AND ORDER
GARAUFIS, District Judge.
Defendant Jeanne Raynor (“Raynor”) moves for summary judgment, pursuant to Fed.R.Civ.P. 56(b), against Plaintiff Diane Kessenich (“Kessenich”) on the first claim in the Amended Complaint. For the rea sons discussed below, Raynor’s motion is denied.
