Issaia v. Russo-Asiatic Bank

The defendants National City Bank of New York and Guaranty Trust Company of New York move to vacate an order of publication purporting to give notice to the defendant Russo-Asiatic Bank of the pendency of this action, and upon vacatur for an order staying further proceedings on the ground that the Russo-Asiatic Bank is a necessary party defendant without whose presence no determination of the controversy may be had.
