OPINION
By PHILLIPS, J.
Jack Chaney executed and delivered to plaintiff, a corporation, two checks payable to its order, drawn on the- Geneva Savings and Trust Company, Geneva, Ohio, dated May 19th and 26th, 1942, respectively, and signed:
“Finer Foods
Jack Chaney.”
*514The bank refused to pay the checks upon presentation. Subsequently Jack Chaney made three payments to plaintiff on the check dated May 19, 1942, but no payments on the check dated May 26, 1942.
