Presently before the court is defendant Kaku Makino’s (“Mr. Makino”) motion to dismiss the first amended complaint (doc. # 53) for lack of subject matter jurisdiction and standing. (Doc. #55). Plaintiff Fairway Restaurant Equipment Contracting, Inc. (“Fairway”) filed a response (doc. # 59), and Mr. Makino filed a reply. (Doc. #60). Mr. Makino additionally requests that this court take judicial notice of the *1128related state and bankruptcy court proceedings affixed to his motion. (Doc. #56).
