This is an appeal from the grant of a motion for summary judgment to the defendant — Tom Howell & Associates, Inc. (Howell). Plaintiff — Wiley, signed an "exclusive listing contract” with defendant Howell for the sale of his home. Included within the "special stipulations” section of the listing contract was the phrase: "w/option to accept appraised in 60 days.” The testimony of the plaintiff — Wiley, and Mr. Wood, an employee of the defendant realty firm, established that Wiley gave Howell the exclusive listing contract to sell his house within 60 days, and if the…
