In December, 1907, Polly Fowler filed suit in the Estill circuit court against lier husband, Louis Fowler, for divorce from bed and board, and in the same action sought to have a verbal contract relative to their respective property rights enforced, and to recover from her husband certain moneys and articles of personal property which she alleged belonged to *328her.
