Appeal from a judgment of the County Court of Schenectady County (Eidens, J.), rendered August 9, 2004, convicting defendant upon his plea of guilty of the crime of robbery in the first degree.
The pertinent facts of this case, in which defendant challenges the legality of certain evidence obtained by the police during a search and seizure following his arrest, are set forth in our prior decision (47 AD3d 1073 [2008]).
