In a medical malpractice action, plaintiffs appeal from an order of the Supreme Court, Queens County, dated May 17, 1977, which granted the motion of defendant Enker for summary judgment on the ground that the action as against him is barred by the Statute of Limitations. Plaintiff-appellant Anthony Rescigno died after the taking of this appeal. On August 30, 1978 letters testamentary were granted to Marie Rescigno, also known as Maria Rescigno.
