This claim for damages arose from an alleged assault and battery committed by a New York State Police Sergeant on or about May 25, 1977. Claimant’s counsel filed and served a notice of intention to file a claim on August 5, 1977, within 90 days of the date of accrual, as required by subdivision 3 of section 10 of the Court of Claims Act. On April 23, 1979, within two years after the claim accrued and as permitted by subdivision 3 of section 10, claimant’s counsel filed and served a notice of claim.
