Petitioner-Appellant Nicholas K. Nichols (Nichols) filed a “Petition for PosUConviction Relief’ (Petition) pursuant to Hawaii Rules of Penal Procedure (HRPP) Rule 40 (2006). Nichols was convicted of numerous offenses in two separate criminal cases—one ease charging felony offenses arising out of a home invasion and shooting and the second case charging felony offenses arising out of a serious assault.
