This is an appeal by the State of Kansas from judgment entered by the district court dismissing the complaint against the defendant for lack of jurisdiction, and remanding the case to juvenile court.

The facts are not in dispute. On September 6, 1985, a juvenile complaint, No. 85-JV-1051, was filed against Danell J. Magness in connection with separate incidents of theft occurring on September 1 and 2,1985.
