Appellant Donna Bennett is the personal representative of the estate of Leon Bennett. Leon Bennett was killed when the boom1 of a crane broke, fell, and struck him while he was working on a construction site. Leon's estate brought a wrongful-death suit against Graves & Associates, the general contractor for the construction project. Graves moved for summary judgment, which was granted, and Bennett appealed. We agree with Bennett that summary judgment was inappropriate.
