This is an appeal by the defendants below from a summary judgment granted in favor of the plaintiffs and from an order denying defendants’ motion to vacate summary judgment.

The facts necessary for a determination of this matter on appeal are as follows. Defendant Allen H. Rhodes was the Registrar of Contractors of the State of Arizona from 13 April 1960 until 16 January 1965.
