I. INTRODUCTION.

Plaintiff, Wesley M. Brown, filed suit in this court against the United States of America (United States) and the City of Oakdale (Oakdale) seeking legal relief as a result of a fall which occurred on the divider between the sidewalk and the street in front of the United States Post Office in Oakdale, Louisiana (the “Post Office”). With the consent of the court, both parties have agreed that this matter would be submitted on briefs in lieu of a trial.
