[1] This is an appeal from an order of the district judge of Terry county, granting a temporary injunction upon a hearing before him. The appellants’ statement in their brief, acquiesced in by appel-lee, is that—

“On June 11, 1921, the sheriff seized said car, laden with intoxicating liquors, under a search warrant, issued the same day, said car being driven by a man named Sim Davis, who was arrested and charged with illegal transportation of such liquors, and who was a few' days later released on bond.
