On April 16, 2009, oral argument was held before the Court on Motions for the Release/Disbursal of Funds filed by DRD Towing, ACL, and Daigle, Fisse & Kessenich (“DFK”). (Rec.Doc.Nos.160, 570, 578). The Court took the matter under advisement and invited further briefing on various issues. At issue are the insurer’s responsibility to reimburse DRD, ACL, and DFK for defense costs and a request for disbursement from those funds deposited by IINA insurance into the Registry of the Court for expenses to date, minus deductible.
