A rehearing was granted in this case upon' the petition of the appellant (who will hereinafter be referred to as the plaintiff). This court had held that, the suit being one to quiet title to real property not in the possession of the plaintiff, and the plaintiff having an adequate remedy at law, the court below had no jurisdiction to try it as a suit in equity, although no question of its right to do so had been raised.
