Bowman, J), entered April 17, 2007, which denied defendant’s motion to dismiss the complaint and granted plaintiffs cross motion to amend the complaint, modified, on the law, to dismiss that part of the complaint alleging a claim for malicious prosecution, and otherwise affirmed, without costs.
