PLAINTIFFS in error will be referred to as manager of safety and the commission, the defendant in error will be referred to as Dice.

Dice, as relator in the trial court, was at the time of the commencement of this suit a police officer in the classified service of the City and County of Denver. In 1919, he took and passed the civil service examination and was certified by the commission, served his probationary period and in 1923 was given first grade in the classified service.
