The defendant in error was pls.ntiff below, and brought his action of assumpsit against the plaintiff • in error, as indorser of a promissory note, in the District Court of the First Judicial District of Colorado Territory, for the county of Arapahoe,, the plaintiff below being the immediate indorsee. •
