I concur in the majority opinion as to division 1.

*149I dissent as to division 2 for the following reasons: In the case when it was here before (Sharpe v. State, 88 Ga. App. 876), this court related a considerable amount of the evidence. I will not repeat that part of the testimony or any of the evidence as to the general grounds, but will add thereto only that part of the testimony of one of the witnesses, the husband of the woman alleged to have been assaulted.
