John F. Irvine entered into a contract with the Louisiana Highway Commission to build a public road, and furnished a statutory bond with the Union Indemnity Company as surety. Suit was brought on an open account for $182.07 against Irvine and the Union Indemnity Company. Judgment was rendered against Irvine by default for the amount claimed; also, against the Indemnity Company for $21.85, from which it prosecutes this appeal. Irvine has not appealed.
