The State of New York constructed, equipped and maintains the Barge canal for the public use. The State is not a common carrier of commerce, intrastate or interstate, but it furnishes the canal .and its facilities without charge to common carriers by water. In aid of commerce it has established a Barge canal terminal at Erie Basin, city of Buffalo, where it has constructed docks and slips for loading and unloading boats, and has laid railroad tracks of standard gauge through the terminal from these docks to the adjacent tracks of the New York Central Railroad Company, the…
