In an action to recover damages for personal injuries, the defendant appeals from an order of the Supreme Court, Suffolk County (Werner, J.), entered June 12, 2002, which denied its motion for summary judgment dismissing the complaint and granted that branch of the plaintiffs cross motion which was to strike its answer based upon its spoliation of evidence to the extent of precluding it from offering certain evidence at trial.
