'Appellant killed his father. He is the eldest of three children and was 18 years old at the time of the tragedy. He claims to have killed in defense of himself and his mother. The mother of appellant had on the day of the tragedy filed suit for divorce against deceased. The evidence indicates that prior to this time she had had* a very unhappy married life, due to the drunken habits of the deceased. He had, according to her testimony, manufactured intoxicants in the home and when under their influence had made many brutal assaults upon her. On the day of the homicide, returning to the home…
