Proceeding pursuant to article 78 of the CPLR to review respondent’s determination dated December 13, 1971, which suspended petitioner’s restaurant liquor license for 10 days beginning January 10, 1972 and imposed a demand for $1,000 upon petitioner’s surety bond. Determination annulled, on the law, without costs. Petitioner is the owner of the licensed tavern. Its president and sole shareholder, Ronald Smallwood, personally operates and manages the tavern on an average of 17 hours a day. In his absence, the tavern is" operated by barmaids.
