MEMORANDUM AND ORDER

HANSON, Chief Judge.

An Indictment was returned by the United States Grand Jury for the Southern District of Iowa on May 20, 1971, against the defendant, Richard Joseph *1180Ziobro, charging him with wilful and knowing failure and refusal to submit to induction into the Armed Forces of the United States in violation of Title 50 Appendix, Section 462 of the United States Code. On July 13, 1971, defendant filed a Motion to Dismiss the Indictment, attacking the legality of the induction order. This ruling is predicated upon the Motion to Dismiss.
