This action was -brought bj the plaintiff to have a certain deed given to defendant by plaintiff and his wife set aside so far as 40 acres of the land therein described was concerned, to have the court decree that defendant held title to said 40 acres as trustee for plaintiff, and decree a reconveyance from defendant to plaintiff of said 46 acres. It was the claim of plaintiff that 80 acres of land belonging to him was conveyed by himself and wife to the defendant under an agreement whereby 40 acres of said land was to become the sole property of defendant in consideration of his paying the…
