The Staggers Rail Act of 1980, Pub.L.No. 96-4M8, 95 Stat. 1895 (to be codified in scattered sections of 11, 45 & 49 U.S.C.) (“Staggers Act” or “Act”) provides the Interstate Commerce Commission (“ICC” or “Commission”) with jurisdiction to review the reasonableness of rates charged by “market dominant” 1 railroads. Under Title II of the Act, however, certain railroad rates and rate increases are deemed reasonable and are thus immune from Commission review.
