This is an action for money had and received. The amended petition alleges that on account “of deposits of money” made by the Southwest Wholesale Grocery Company, the respondent is indebted to the assignor of appellants. Respondent’s answer admitted that the Southwest Wholesale Grocery Company was a depositor and that all the deposits.,made by it “created a duty on the part of the defendant to pay on demand out of said deposits all checks signed by the Southwest Wholesale Grocery Company,” and the answer further alleged that all deposits made by the company “were withdrawn on checks signed in…
