This cause was appealed to the honorable Court of Civil Appeals for the Second Supreme Judicial District on December 2, 1911, upon authority of the case of Southern Pacific Railway Co. v. Sorey, 142 S. W. 119, and in accordance with the provisions of sections 1 and 4 of House Bill No. 25, passed by the Thirty-Second Legislature, the same was ordered transferred to this court. Prior to the transfer thereof, the case had been submitted, and by an able opinion, rendered by Chief Justice Connor, the judgment of the lower court was reversed, the order appointing the receiver vacated, and the…
