Eight persons were indicted under one indictment. Two of them did not appear; as to two, the jury disagreed; one, Carmine Anzalone, pleaded guilty; and the remaining three are now before this court.

On March 3, 1935, one Drukman was murdered in a garage on Moore and White streets, Brooklyn. Immediately thereafter, Meyer and Harry Luckman and Fred J. Hull were seized by the police at the scene of the crime. They were held to await the action of the grand jury.
