The Court has voted unanimously to deny the Secretary’s motion for a full-Court decision in this matter. As the author of the panel opinion in this case, Snyder v. Principi, 15 Vet.App. 285 (2001) [hereinafter Snyder II ], and as a member of the panel that decided the companion case of Cox v. Principi, 15 Vet.App. 280 (2001) (per curiam order) [hereinafter Cox IV], I write separately to address the Secretary’s flawed arguments, because, in the event of further appellate review, I believe that the record in this Court should be as complete as possible.1
