Appellant’s claim against the estate herein alleges that, at the instance and request of the decedent, appellant loaned him $1,000 in August 1930; that, at the end of a year, decedent asked that the loan be extended on the payment of $50 and in 1932, on the payment of $50, said loan was extended for another year, and again in August of each succeeding year up to and including 1935, on the payment of $50, the loan was extended on oral agreement between the appellant and the decedent; that there is still due and owing appellant $1,000 with five per cent interest from August, 1935, and that no…
