1Opinion of the Court

Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered February 5, 2008, which revoked defendant’s probation and imposed a sentence of imprisonment.

In 2006, defendant pleaded guilty to criminal sale of a controlled substance in the fifth degree and was sentenced to six months in jail and five years of probation. County Court subsequently found that defendant violated certain terms of his probation and, as a result, revoked his probation and resentenced him to 2V2 years in prison and one year of postrelease supervision.
