Appeal from circuit court, Greene county. The plaintiff herein, by a deed bearing date February 8, 1882, conveyed to the defendant the New York, West Shore & Buffalo Railway Company a strip of land, being a portion of his farm, to enable the grantee to construct its proposed railway across his land. The deed contained the following provisions: “The party of the second part is to reconstruct and restore the public road, and place the same along the westerly line of and *173upon the aforesaid premises.
