Appeal by the relator, George Edwin Leet, from an order of the Supreme Court, made at the Mew York Special Term and entered in the office of the clerk of the county of Mew York on the 27th day of May, 1898, denying the relator’s motion for a writ of mandamus commanding the respondent to reinstate the relator in the place of superintendent of the city hospital.

O’Brien, J.:

The relator was appointed in 1896 superintendent of the city hospital by the commissioner of public charities formerly of the city of Mew York. By the regulations of the civil service commis*249sioners of the then city, the position occupied by the relator was one of those to be “ filled by selection from those who have passed highest in open competitive examinations.” On January 1, 1898, the relator was transferred to the employment of the" new city in the department of public charities, and he was removed therefrom on March thirty-first, the removal to date from April 1, 1898.
