CALOGERO, Justice.

Defendant, Robert Hicks, was charged by grand jury indictment with the aggravated rape of his eleven year old stepdaughter, in violation of R.S. 14:42. A jury found him guilty as charged and the trial court sentenced him to life imprisonment at hard labor without benefit of parole, probation, or suspension of sentence. The defendant moved for a new trial based essentially upon newly discovered evidence, alleging that he had not received an exculpatory medical report from the state prior to trial.
