This is the second appeal in this case.' The opinion on the first appeal will be found in 124 Ark., page 154, under the style of Tancred v. First National Bank of Fort Smith. The firm of Harper & Wilson was indebted to the First National Bank in a large sum of money which was secured by a mortgage on real estate. Harper died and M. T. Tancred, who is Mrs. Harper’s brother, became indebted to the bank in the sum o'f $5,000.
