Nuessle, J.. In February, 1928, Otto Siegert brought an action of forcible entry and detainer in a justice court of Traill county wherein Edith Yinquist and Carl A. Shellberg were defendants. In his com plaint in that action Siegert alleged that be was the owner of certain real property; that in November, 1926, the Hillsboro National Bank leased the property in question to Edith Vinquist for a term of one year ending on November 23rd, 1927; that Carl A.
