This proceeding was commenced by an order to show cause dated February 13, 1940. The relief sought herein is the amendment of a claim against the State of New York, filed *851in the office of the clerk of the Court of Claims on April 30, 1917, in the respects set forth in the proposed amended and supplemental claim attached to the moving papers.

Briefly stated, it appears that chapter 147 of the Laws of 1903 provided for the issuance and sale of bonds in a sum not to exceed $101,000,000, to be expended for the purpose of improving the Erie, Oswego and Champlain Canals, and the procurement of land…
