When this case was first before this court (Richards v. Smith, 170 Ga. 398, 153 S. E. 44), there was a reversal because the court erred in directing a verdict for the plaintiff. On the subsequent trial the jury returned a verdict for the plaintiff, and the exception is to the judgment overruling the defendant’s second motion for a new trial. The action was a statutory complaint for land, in which the plaintiff’s sole claim of title was under a duly recorded deed purporting to have been executed by the defendant to the plaintiff.
