RE: INJUNCTION AND DECLARATORY RELIEF

Pending before the Court are: (a) Defendants’ Motion to Dismiss Counts One, Two and Three of the Puerto Rico Diary Farmers Association’s Second Amended Complaint for Lack of Standing Pursuant to Fed.R.Civ.P. 12(b), Docket No. 35; and (b) Plaintiffs Opposition to Government Defendant’s Motion to Dismiss for Lack of Standing Filed at Docket No. 35, Docket No. 38. For the reasons set forth below, the motion to dismiss is DENIED.1
