Appeal from the Bes Homes District Court. The question made upon the demurrer to the indictment, is whether the facts alleged constitute a public offence. The defendant is charged with vending and retailing spirituous liquors and intoxicating drinks, without having first complied with the conditions and obtained license, as required by the first section of the act *493entitled “ an act to license and regulate the sale of malt, spirituous and vinous liquors in the state of Iowa,” approved January 29,1857.
