Judgment unanimously affirmed. Memorandum: Defendant’s chief contention in his appeal from a judgment after conviction by a jury of manslaughter in the second degree (Penal Law, § 125.15) is that while the proof might have sustained a conviction for criminally negligent homicide (Penal Law, § 125.10), it does not sustain a conviction for manslaughter in the second degree and that the judgment should be modified accordingly.
